Welcome to WorkBeaver.com ("WorkBeaver," "we," "us," or "our"). These Terms of Service ("TOS") govern your access to and use of our website, software, and services (collectively, the "Service"). By accessing or using the Service, you ("you" or "User") agree to be bound by these TOS and our Privacy Policy. If you do not agree to these TOS, you may not access or use the Service.

2. Legal Jurisdiction and Dispute Resolution

These TOS are governed by and construed in accordance with the laws of the United Kingdom. Any dispute arising out of or relating to these TOS or the Service shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

The Service is intended for use by individuals and businesses. You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

5. Description of Service

WorkBeaver provides downloadable software as a subscription service that automates tasks on your computer using AI. The software records your screen during a demonstration of a workflow and then replays the workflow, using AI to navigate and adapt to achieve the desired task.

Core Features:

  • Workflow Recording: Records your screen, mouse movements, and keyboard inputs as you demonstrate a task.
  • AI-Powered Playback: Uses AI to replicate the recorded workflow, adapting to changes in the environment.
  • Contextual Understanding: Generates questions at the end of recording to gather additional context and ensure accurate task execution.

Limitations:

  • Incorrect user input during recording or answering questions may lead to inaccurate task execution.
  • While safeguards are in place, there is a possibility of the AI taking unintended actions.
  • The software's performance depends on the user accurately demonstrating the workflow and providing correct information.

The software is compatible with Mac and Windows operating systems. Specific system requirements are available on our downloads page.

6. Software License

Subject to your compliance with these TOS and payment of applicable fees, WorkBeaver grants you a limited, non-exclusive, non-transferable, revocable license to use the software for personal and commercial purposes.

Permitted Uses:

  • Using the software to automate tasks on your computer for your own personal or business use.

Prohibited Uses:

  • Reverse engineering, decompiling, disassembling, or attempting to derive the source code of the software.
  • Modifying, adapting, or creating derivative works of the software.
  • Distributing, sublicensing, renting, leasing, or loaning the software to any third party.
  • Using the software for any illegal or unauthorized purpose.
  • Circumventing any usage restrictions or security measures.
  • Any other illegal activities.

7. AI Specifics

Functionality:

The AI records the user’s screen, and uses this data to control the user’s computer during playback to perform the demonstrated task.

Data Collection and Use:

All data is encrypted end-to-end with zero-knowledge protocols. Data is only decrypted in the server's RAM during playback and is immediately deleted afterward. No data is used for training or service improvement. No employees have access to unencrypted user data. Please see our Privacy Policy for more information.

Limitations:

No AI system is 100% accurate. While WorkBeaver implements safeguards to prevent errors, there is a possibility of incorrect actions.

Disclaimers:

WorkBeaver is not responsible for any decisions or actions taken by the AI. You are ultimately responsible for your use of the Service and any consequences arising from the software, service, or AI's actions.

8. Updates and Maintenance

The software may be updated frequently to improve performance, add features, or address bugs. Updates will be automatic. Scheduled maintenance downtimes may occur and will be announced in advance.

9. Subscription and Payment

Subscription Model:

WorkBeaver offers a standard subscription tier that provides access to the Service and a monthly allowance of "Actions." Actions include mouse clicks, keyboard inputs, and other interactions with your computer during workflow recording and playback.

Subscription Tiers

  • Standard Subscription: Includes a monthly allowance of Actions.
  • Additional Actions: Users can purchase permanent Actions as a top-up, benefiting from volume-based discounts.

Pricing:

The standard subscription price is $35 per month. Discounted pricing may be offered for early adopters.

Additional Fees:

Fees apply for purchasing additional permanent Actions.

Price Changes:

Prices are subject to change. Users will be notified of any price changes via email.

Payment Terms:

We accept payment through Stripe. Subscription fees are due monthly in advance. One-time payments are required for Action top-ups.

Billing Cycle:

Monthly.

10. Refunds and Cancellations

Refund Policy:

Partial refunds for the monthly subscription may be granted based on the number of Actions used during the billing period. No refunds are available if all Actions from the monthly quota have been used. Refunds for permanent Actions are partial and depend on the purchase date.

Refund Circumstances:

Refunds are granted as per legal requirements.

Cancellation:

You can cancel your subscription at any time through your account management page on our website or by contacting customer support.

Penalties:

There are no penalties for early cancellation. Your subscription will remain active until the end of the current billing period.

11. Free Trial

WorkBeaver offers a 7-day free trial with full access to all features. At the end of the trial, your access will be revoked unless you purchase a subscription. You will be automatically charged if you do not cancel before the end of the trial period.

12. User Accounts and Data

Account Creation:

To create an account, you must provide your name and email address. Email verification may be required if not logging in via Google social login.

Account Security:

You are responsible for maintaining the security of your account, including choosing a strong password and safeguarding your login credentials. WorkBeaver employs security measures such as data encryption at rest and multi-factor authentication to protect user accounts.

Data Privacy and Security:

WorkBeaver collects personal data as outlined in our separate Privacy Policy. User data is used, stored, and protected as described in the Privacy Policy. All data is encrypted at rest, and workflow data is end-to-end encrypted with zero-knowledge encryption. User data may be shared with third parties as outlined in the Privacy Policy. WorkBeaver complies with relevant data privacy regulations (e.g., GDPR, CCPA) using in-house procedures and policies.

Data Retention:

Data retention policies are detailed in our Privacy Policy. User data is handled as outlined in the Privacy Policy upon account cancellation or termination.

13. User-Generated Content

Rules:

Users must comply with all applicable laws and regulations regarding user-generated content. Prohibited content includes, but is not limited to, illegal, harmful, abusive, defamatory, or infringing material.

Ownership:

Users retain ownership of their generated content and grant WorkBeaver a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the Service.

14. Intellectual Property

WorkBeaver Limited owns all copyrights, trademarks, and other intellectual property rights associated with WorkBeaver and the Service. You may not use WorkBeaver's brand name, logos, or other intellectual property without our prior written consent, including but not limited to claiming representation.

15. User Conduct

You agree to use the Service only for lawful purposes and in accordance with these TOS.

Prohibited Activities:

  • Spamming, hacking, or uploading malicious code.
  • Engaging in any activity that disrupts or interferes with the Service.
  • Violating the intellectual property rights of others.
  • Any illegal or unethical behaviour, or otherwise previously mentioned prohibited behaviour.

Consequences of Violation:

Violation of these rules may result in, but not limited to, account termination, forfeiture of refunds, and potential legal action.

16. Third-Party Integrations

The Service may integrate with third-party services, such as AWS, Google products, and Atlassian products. Your use of these third-party services is subject to their respective terms of use. WorkBeaver is not responsible for the actions or availability of these third-party services.

17. Disclaimers, Liability, and Termination

Disclaimer of Warranties:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability:

WORKBEAVER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (D) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY; (E) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE; AND/OR (F) THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY. THE USER IS RESPONSIBLE FOR ALL USE OF THE SOFTWARE AND ACTIONS THEY PERFORM WITH THE SOFTWARE, THE USER ACCEPTS ALL LIABILITY.

Indemnification:

You agree to indemnify and hold harmless WorkBeaver and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Service, your violation of these TOS, or your infringement of any intellectual property or other right of any third party.

Termination:

WorkBeaver may terminate your account and access to the Service at any time, without notice or liability, for any reason, including if you breach these TOS. Upon termination, your right to use the Service will immediately cease. You may appeal account termination by contacting customer support. Termination may result in, but not limited to, forfeiture of refunds, compensation.

Force Majeure:

WorkBeaver shall not be liable for any failure to perform its obligations under these TOS if such failure is caused by events beyond its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

18. Miscellaneous

Severability:

If any provision of these TOS is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement:

These TOS constitute the entire agreement between you and WorkBeaver regarding the Service and supersede all prior or contemporaneous agreements, whether written or oral.

Waiver:

No waiver of any provision of these TOS shall be deemed a further or continuing waiver of such provision or any other provision.

Assignment:

You may not assign these TOS or any of your rights or obligations hereunder without WorkBeaver's prior written consent. WorkBeaver may assign these TOS or any of its rights or obligations hereunder without your consent.

Accessibility:

WorkBeaver strives to adhere to accessibility standards (WCAG) where feasible but does not guarantee full compliance.

19. Changes to These Terms

WorkBeaver reserves the right to modify these TOS at any time. We will notify you of any material changes by posting the new TOS on our website and updating the effective date. Your continued use of the Service after the changes become effective constitutes your acceptance of the revised TOS.
